If your facility stores oil or petroleum products, there’s a good chance you have regulatory obligations you may not fully realize, and regulators won’t accept “we didn’t know” as a defense. A Spill Prevention, Control, and Countermeasure (SPCC) Plan is a federal requirement under the Clean Water Act. This document and plan of action explains how your facility prevents oil spills, what systems are in place to contain them, and how your team will respond if an accident occurs. The law requires facilities that meet certain requirements to implement an SPCC Plan with the aim of preventing spilled oil from reaching rivers, lakes, wetlands, storm drains, and other waterways.     

Many organizations across New Jersey and New York assume SPCC requirements only apply to large industrial operations, but the rule actually applies to a wide range of businesses, from small maintenance yards to schools and commercial facilities with backup generators. Regulators expect facility operators and owners to have a plan and understand how to implement it.

What an SPCC Plan Looks Like in Practice and What the Law Requires

SPCC compliance is not just about paperwork. It is about operational awareness and understanding your obligations before an inspection, or worse, a spill. While that sounds straightforward, a compliant SPCC Plan is not a generic template. It is a site-specific document that reflects your operations, equipment, and the potential risks therein. Regulators expect your plan to demonstrate two things. The first is that you’ve evaluated how oil could be released at your facility, and that considerable steps have been taken to prevent it from happening. The second thing is that you have planned to ensure that if a spill does happen, you are prepared to prevent it from reaching and contaminating waterways.

The plan is required to describe your facility layout and identify all oil storage containers along with their capacities. It also needs to outline spill prevention measures such as equipment design, secondary containment, and standard operating procedures. Just as importantly, it must address drainage patterns, showing how a spill would move across your site and what controls are in place or available to stop it.

Secondary containment is also a central requirement. Facilities must have physical systems capable of containing the contents of the largest container, plus additional capacity to account for precipitation if the oil is stored outdoors. This could include berms, dikes, double-walled tanks, or spill containment pallets, depending on the setup.

When are you Required to get an SPCC Plan?

One of the most common misconceptions is that SPCC only applies to facilities that store large volumes of fuel. In reality, your responsibility under the law is determined by a combination of storage capacity and potential environmental impact.

If your facility stores oil or oil-based products, such as diesel fuel, gasoline, hydraulic oil, lubricants, or even certain food-grade oils, you may fall under the rule. The federal threshold is 1,320 gallons of aboveground storage capacity or 42,000 gallons of underground storage capacity. That aboveground threshold in particular is easier to reach than many realize, especially because it’s about how much you can store, not how much you typically have stored. Multiple 55-gallon drums, small tanks, and generator day tanks can add up quickly, and they all count toward this total, regardless of how full they normally are.

The second factor that determines if you are required to have an SPCC plan is about location and how close you are to waterways. If a spill could reasonably reach a storm drain, drainage ditch, or stream and eventually reach a navigable waterway, your facility is probably required to have an SPCC. In states like New Jersey and New York, where stormwater systems and waterways are common, many sites that appear to be low risk still qualify under this requirement.

Certification Requirements: Do You Need a Professional Engineer for a SPCC?

If your facility has larger storage capacities or is at high risk, chances are your SPCC plan requires certification by a Professional Engineer (PE).  However, smaller facilities such as those with 10,000 gallons or less of aboveground oil storage and no significant spill history may qualify to self-certify their plans. While this can simplify the process, it does not reduce your responsibility. Self-certified plans must still meet all regulatory requirements and are subject to the same level of enforcement.

Misunderstanding this distinction is a common compliance issue, and it often leads to facilities either overestimating or underestimating what is required of them. If you are unsure of your responsibilities, your best course of action is to reach out to a professional engineer. Even if you are eligible to self-certify, you may choose to have your plan prepared by a professional engineer with experience in preparing SPCC Plans.

Where Facilities Commonly Fall Short with their SPCC Plans

Most SPCC violations are not the result of intentional neglect. Facility operators frequently underestimate their storage capacity by overlooking smaller containers or systems. In other cases, facilities install tanks without adding proper secondary containment or fail to update their plans after changes occur at the facility that affect oil storage.

Another common issue is treating the SPCC Plan as a one-time thing. Regulators expect it to be a living document, and that facility owners continue performing ongoing inspections, training, and update their plan as things change. SPCC Plans have to be reviewed and updated when changes occur and at a minimum, every five (5) years. A plan that exists on paper but is not implemented in daily operations will not hold up under the scrutiny of a regulator’s inspection.
